I. GENERAL PROVISIONS

1. The Online Store at www.jusky.pl is run by JUSKY SC Jasikowski, Juszczak entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the minister responsible for economy, having the address of the place of business and address for service: ul. Nowohucka 1/2, 54-617 Wrocław, Tax ID: 894-31-34-853, National Business Registry Number: 381754152, e-mail address (e-mail): info@jusky.pl, tel. 71 793 40 70.

2. The www.jusky.pl online store operates on the terms set out in these Terms and Conditions.

3. The Terms and Conditions define the types and scope of services provided electronically by the Online Store www.jusky.pl, the rules for the provision of these services, the conditions for concluding and terminating contracts for the provision of electronic services and Product Sales Agreements, as well as the complaint procedure.

4. Each Service Recipient, upon taking steps to use the services of the Online Store www.jusky.pl, is obliged to comply with the provisions of these Terms and Conditions.

5. The condition for placing an order in the Online Store by the Customer is to read the Terms and Conditions and accept its provisions at the time of placing the Order.

6. The www.jusky.pl online store conducts retail and wholesale sales of Products – professional cutting tools via the Internet in Poland.

7. All Products offered in the Online Store are new, free from legal defects and have been legally placed on the Polish market.

8. In matters not covered by these Terms and Conditions, the following provisions shall apply: Act on the provision of electronic services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended), the Act on consumer rights of May 30, 2014 (Journal of Laws of 2014, item 827), the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), Regulation of the European Parliament and the Council of the European Union 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (hereinafter the name of the GDPR) and other relevant provisions of Polish law.

II. DEFINITIONS

BUSINESS DAY – one day from Monday to Friday, excluding public holidays.
REGISTRATION FORM – a form available on the website www.jusky.pl that allows you to create an Account.
ORDER FORM – a form available on the website www.jusky.pl that allows for placing an Order.
ACCOUNT – marked with an individual name (login) and password, a collection of resources in the Service Provider’s IT system, in which the Service Recipient’s data is collected, including information about placed Orders.
CONSUMER – a natural person who performs a legal transaction with the entrepreneur not related directly to his business or professional activity.
CUSTOMER – a Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller.
Terms and Conditions – these Terms and Conditions of the Online Store.
ONLINE STORE – the Service Provider’s Online Store operating at www.jusky.pl.
SELLER, SERVICE PROVIDER – JUSKY SC Jasikowski, Juszczak with headquarters in Wrocław, ul. Nowohucka 1/2, 54-617 Wrocław, Tax ID: 894-31-34-853, National Business Registry Number: 381754152.
PRODUCT – a movable item available in the Online Store which is the subject of the Sales Agreement between the Customer and the Seller.
SALES AGREEMENT – Product Sales Agreement concluded between the Customer and the Seller via the Online Store.
SERVICE RECIPIENT – a natural person, legal person or an organizational unit without legal personality, which the law grants legal capacity using the Electronic Service.
ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Online Store.
ORDER – Customer’s declaration of will constituting an offer to conclude a Product Sales Agreement with the Seller.
ORDER COMPLETION STATUS – a message visible after logging in to the Customer’s Account, indicating the stage at which the order is being processed. Possible statuses: confirmation of order acceptance, confirmation of the order (shipment).
NEWSLETTER – a service that allows the Service Recipient to subscribe to and receive free information from the Service Provider regarding the Products available in the Store to the e-mail address provided by the Service Recipient.

III. TYPE AND SCOPE OF ELECTRONIC SERVICES

The Service Provider enables the use of Electronic Services via the Online Store, such as:
keeping an Account in the Online Store,
concluding Product Sales Agreements,
using the Newsletter Service.
The provision of Services to the Customers in the Online Store takes place under the conditions specified in the Terms and Conditions.
In order to create an Account, the Customer is asked to provide the following data: First and last name Address, tax identification number (for entrepreneurs), telephone number, e-mail address.
The Service Provider has the right to post advertising content on the website of the Online Store. The advertising content referred to in the preceding sentence is an integral part of the Online Store and the materials presented therein.

IV. CONDITIONS FOR THE PROVISION AND CONCLUSION OF CONTRACTS FOR THE PROVISION OF ELECTRONIC SERVICES

Payment:
Provision of Electronic Services specified in Chapter III point 1 of the Terms and Conditions by the Service Provider is free of charge.
The period for which the contract is concluded:
The contract for the provision of Electronic Services consisting in maintaining an Account in the Online Store is concluded for an indefinite period.
The contract for the provision of Electronic Services consisting in the possibility of placing an Order in the Online Store is concluded for a definite period of time and is terminated when the Order is placed or the Customer ceases to submit it.
Technical requirements necessary for cooperation with the ICT system used by the Service Provider:
A computer with Internet access.
Access to e-mail.
Web browser.
Enabling Cookies and Javascript in the web browser.
Minimum screen resolution for an application: 800 × 600, recommended resolution 1024 × 768 or higher
The Service Recipient is obliged to use the Online Store in a manner consistent with the law and morality, with respect for personal rights and intellectual property rights of third parties.
The Service Recipient is obliged to enter data consistent with the facts.
The Service Recipient is prohibited from providing illegal content.

V. CONDITIONS FOR CONCLUDING SALES CONTRACTS

Information on the websites of the Online Store does not constitute an offer within the meaning of the law. By placing an order, the Customer submits an offer to buy a specific Product under the conditions specified in the Product description.
In the event of unavailability of some or all of the Products constituting the order, the Customer is informed about it by e-mail or by phone and asked for a decision on further implementation (canceling the order, processing without missing goods, longer waiting for implementation, choosing another product in place of the missing one) .
The price of the Product shown on the website of the Online Store is given in Polish zlotys (PLN) and includes all components, including VAT, customs duties and all other components. The price does not include delivery costs.
The Product price shown on the Online Store website is binding at the time of placing the Order by the Customer. This price will not change regardless of price changes in the Online Store, which may occur for individual Products after the Customer places an Order.
In order to place an Order, the Customer is not required to register an Account in the Online Store.
Orders can be placed via: the website using the Order Form (Online Store www.jusky.pl) – 24 hours a day all year round. The store carries out orders placed from Mon-Fri. from 07:30 to 15:30.
An e-mail to the address info@jusky.pl (the store carries out orders from Monday to Friday from 07:30 to 15:30).
Conclusion of the Sales Agreement.
To conclude a Sales Agreement, it is necessary for the Customer to submit an Order in advance using the methods made available by the Seller.
After placing the Order, the Seller immediately confirms its receipt, which binds the Customer with his Order. Confirmation of receipt of the Order is made by sending an e-mail message containing: confirmation of all essential elements of the Order, Store’s statement on receipt of the Order, Store’s statement on acceptance of the Order, these Terms and Conditions. Consumer’s statement on withdrawal from the contract. instruction on the right to withdraw from the contract.
Upon receipt by the Customer of the e-mail referred to in point 7, a Sales Agreement is concluded between the Customer and the Seller.
Each Sales Agreement will be confirmed by a VAT invoice that will be attached to the shipment. In order to receive a VAT invoice, you must provide the data needed to issue it when placing the order.
Orders placed on weekdays after 3.30 p.m., on Saturdays, Sundays and public holidays, will be processed on the next business day.

VI. METHODS OF PAYMENT

The Seller provides the following payment methods:
Payment on delivery for the so-called Cash on delivery;
Traditional bank transfer PKO Bank Polski SA: no. PL77 1020 5242 0000 2202 0439 5505, (Jusky SC Jasikowski, Juszczak, ul. Nowohucka 1/2, 54-617 Wrocław; The order number should be provided in the title of the transfer);
Payment via the payment services PayPAL.pl, PayU.pl;
Payment upon personal collection; The Customer is obliged to pay the price under the Sales Agreement within 14 days from the date of its conclusion, unless the Sales Agreement provides otherwise.
Failure to pay the Customer in due time shall mean the cancellation of the Order.
In the case of payment by bank transfer, the
Product is sent after the amount is credited to the Seller’s bank account.
In the case of payment on delivery, the parcel is sent after verification of the correctness of the address data.

VII. COST, TIME AND METHODS OF DELIVERY

Product delivery costs are determined during the ordering process and depend on the choice of payment method and delivery method of the purchased Product.
Products purchased in the Online Store are shipped via courier company or Poczta Polska.
Products purchased in the Online Store are shipped via the GLS courier company.
The purchased Products can be picked up in person at Sales office, ul. Nowohucka 1/2, 54-617 Wrocław.
The date of delivery of the Product consists of the time of completing the Product and the time of delivery of the Product by the carrier:
The time for completing the Product is 1 Business Day;
The delivery of the Product by the carrier takes place within 1 Business Day for courier shipments declared by the carrier and 3 Business Days for shipments by Poczta Polska.

VIII. TERMS AND CONDITIONS OF TERMINATION OF CONTRACTS FOR THE PROVISION OF ELECTRONIC SERVICES

Termination of the contract for the provision of Electronic Services:
A contract for the provision of an Electronic Service of a continuous and indefinite nature (e.g. keeping an Account in the Online Store) may be terminated.
The Service Recipient may terminate the contract with immediate effect and without giving reasons by sending an appropriate statement via e-mail to the following address: info@jusky.pl or in writing to the following address: Jusky S.C. Jasikowski, Juszczak – Sales office, ul. Nowohucka 1/2, 54-617 Wrocław;
The Service Provider may terminate the contract for the provision of electronic services of a continuous and indefinite nature in the event that the Service Recipient violates the Terms and Conditions, in particular when he provides unlawful content after an unsuccessful prior call to cease the violations with an appropriate deadline. In such a case, the contract expires after 7 days from the date of submitting the declaration of will to terminate it (notice period).
The termination leads to the termination of the legal relationship with effect for the future.
The Service Provider and the Service Recipient may terminate the contract for the provision of Electronic Services at any time by agreement of the parties.

IX. COMPLAINT PROCEDURE

Complaints for non-compliance of the Product with the Sales Agreement:
The basis and scope of the Seller’s liability towards the Customer who is a Consumer, for the Product’s non-compliance with the Sales
Agreement, are specified in the Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended).
Notifications of the Product’s non-compliance with the Sales Agreement and the submission of a relevant request may be made via e-mail to the following address: info@jusky.pl.
In the above e-mail message, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of occurrence of the irregularity and contact details. The information provided will significantly facilitate and accelerate the consideration of the complaint by the Seller.
When it is necessary to assess the non-compliance of the Product with the contract, it should be delivered to the address indicated above. Please attach the proof of purchase of the Product.
In the event of non-compliance of the Product with the Sales Agreement resulting from the delivery (e.g. damaged packaging, broken security tapes), please prepare a complaint protocol in the presence of the courier and attach it to the returned shipment.
The Seller will respond to the Customer’s request immediately, no later than within 14 days. The response to the complaint is sent to the e-mail address provided by the Customer or in another way provided by the Customer.
In the case of a complaint from a Customer who is a Consumer – failure to consider the complaint within 14 days is tantamount to its consideration; In connection with a justified complaint of the Customer who is a Consumer, the Seller covers the costs of collection, delivery and replacement of the goods with one free from defects; Complaints related to the provision of Electronic Services by the Service Provider:
Complaints related to the provision of Electronic Services via the Online Store may be submitted by the Service Recipient via e-mail to the following address: info@jusky.pl; In the above e-mail, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of irregularities and contact details. The information provided will significantly facilitate and accelerate the consideration of the complaint by the Service Provider. C) The complaint is considered by the Service Provider immediately, no later than within 14 days. the method provided by the Customer.

X. RIGHT TO WITHDRAW FROM THE CONTRACT

A customer who is also a Consumer who has concluded a distance contract may withdraw from it without giving reasons by submitting an appropriate statement in writing within 14 days. To meet this deadline, it is enough to send the declaration of withdrawal from the contract provided by the Store.
In the event of withdrawal from the contract, the Sales Agreement is considered void and the Consumer is released from any obligations. What the parties have testified is returned unchanged, unless the change was necessary within the ordinary management. The return should be made immediately, no later than within 14 days.
The Seller will refund the value of the Product along with the costs of its delivery using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of return, which does not involve any costs for him.
If the Consumer has chosen a Product delivery method other than the cheapest standard delivery method offered by the Online Store, the Seller is not obliged to refund the additional costs incurred by the Consumer.
The consumer withdrawing from the Sales Agreement, in accordance with point 1 of this chapter, bears only the costs of returning the Product to the Seller.
The fourteen-day period during which the Consumer may withdraw from the contract is counted from the day on which the Consumer took possession of the Product.
The right to withdraw from a distance contract is not entitled to the Consumer in cases of benefits that, due to their nature, cannot be returned. This also applies to Products made on an individual order;

XII. FINAL PROVISIONS

Agreements concluded via the Online Store are concluded in accordance with Polish law.
Changes made to the Terms and Conditions of the Online Store by the Service Provider shall be binding on the Service Recipient, provided that he has been properly informed about the changes and has not terminated the contract for the provision of electronic services within 14 days from the date of notifying the Service Recipient about the changes by the Online Store.
In the event of non-compliance of any part of the Terms and Conditions with applicable law, the Service Provider declares absolute compliance and application of this law in place of the challenged provision of the Terms and Conditions.
Any disputes arising from the Sales Agreements between the Online Store and Consumers will be settled first by negotiation, with the intention of amicable settlement of the dispute. However, if this would not be possible or would be unsatisfactory for either party, disputes will be resolved by a competent common court (in accordance with point XII. 5.)
Court settlement of disputes:
Any disputes arising between the Service Provider and the Service Recipient (Customer) who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure of November 17, 1964 (Journal of Laws No. of Laws No. 43, item 296 as amended).
Any disputes arising between the Service Provider and the Service Recipient (Customer) who is not also a Consumer shall be submitted to the court having jurisdiction over the Service Provider’s seat.
